Acceptable Use Policy

  1. Definitions
    • “Cloudfinity”, “we”, “us”, or “our” refers to Cloudfinity Pty Ltd with ABN 19 671 632 438 and its employees or agents.
    • Client refers to any entity that signs up a product or service with Cloudfinity. A client of Cloudfinity is also referred to as “you” and “your”.
    • This Acceptable Use Policy (the “Policy”) outlines the acceptable and prohibited uses of our cloud services, including virtual private servers (VPS), virtual private cloud (VPC), dedicated servers, colocation, IP transit, and cloud connectivity (“Services”) as provided by Cloudfinity.
  1. Acceptable Use
    • Our Services are provided for you to use for legitimate purposes, such as website hosting, file storage, and remote application hosting.
    • You may not use our Services for any purpose that violates this Policy or any applicable laws or regulations.
    • By using our Services, you agree to comply with this Policy. We reserve the right to modify this Policy at any time without notice, and any such changes will become effective immediately upon posting.
  1. Prohibited Activities
    • You may not use our Services to engage in any of the following activities.
    • Gaming Services: You are not permitted to host or operate game servers, including but not limited to multiplayer game servers, dedicated game servers, or gaming voice servers, on our infrastructure. This restriction applies to both commercial and non-commercial game server hosting.
    • VPN Services: The use of our services to operate as a public VPN provider is strictly prohibited. Our services are intended for personal or business use by individual customers and organisations. You are not permitted to resell, share, or provide VPN services to third parties using our infrastructure. Any activity related to acting as a public VPN provider, including but not limited to offering VPN services, selling VPN access, or facilitating VPN connections for third parties, is strictly prohibited.
    • IRC (Internet Relay Chat) Services: You are not permitted to operate Internet Relay Chat (IRC) services, including but not limited to hosting IRC servers, operating IRC networks, or participating in IRC-based activities. IRC servers consume significant network resources and can pose security risks.
    • Illegal Activities: Any activity that violates applicable laws or regulations, including, but not limited to, intellectual property infringement, hacking, cracking, distribution of counterfeit software, and phishing scams.
    • Spamming: Sending unsolicited bulk email messages, including commercial advertising and informational announcements.
    • Malware: Distributing or hosting any form of malware, including viruses, Trojans, worms, and other malicious software.
    • Hacking and Cyberattacks: Any activity that attempts to gain unauthorised access to any network, system, or data.
    • Network Abuse: Any activity that impairs or disrupts the performance of our network, including but not limited to, port scans, denial-of-service attacks, and unauthorised network monitoring.
    • Adult Content: Hosting or distributing pornographic or sexually explicit material.
    • Gambling: Hosting or distributing any form of online gambling content.
    • Resource Abuse: Any activity that consumes excessive network, disk, or CPU resources, including but not limited to cryptocurrency mining, email bombing, and server stress testing.
  1. Account Security
    • You are responsible for maintaining the security of your account and ensuring that your passwords and access credentials are kept confidential.
    • You must notify us immediately if you become aware of any unauthorised access to your account or breach of your security.
  1. Consequences of Violation
    • We reserve the right to suspend or terminate your Services immediately if you violate this Policy. We may also report any illegal activity to the appropriate law enforcement agencies.
